1. Agreement to Terms

By accessing or using The Borrowed Garden's services, website, or placing a rental order, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

2. Rental Services

2.1 Rental Period

Plant rentals begin on the pickup date and end on the return date specified in your order. Rental fees are calculated on a daily basis as indicated at checkout.

2.2 Pickup and Return

You are responsible for picking up and returning plants on the agreed dates. Late returns may incur additional daily rental charges. We will contact you regarding pickup and return logistics.

2.3 Plant Care

During the rental period, you are responsible for the reasonable care of the plants. This includes providing appropriate light, water, and temperature conditions as outlined in the care instructions provided with each plant.

3. Payment Terms

Full payment is required at the time of booking. We accept major credit cards through our secure payment processor, Stripe. All prices are in USD and include applicable taxes as shown at checkout.

By providing payment information, you represent that you are authorized to use the payment method and authorize us to charge the total amount shown.

4. Cancellation and Refunds

• 7+ days before pickup: Full refund
• 3-6 days before pickup: 50% refund
• Less than 3 days before pickup: No refund

5. Damage and Loss

You are responsible for any damage to or loss of rented plants during the rental period, excluding normal wear and natural leaf shedding.

In case of significant damage or loss, you may be charged a replacement fee based on the wholesale value of the plant. We will assess any damage upon return and contact you if additional charges apply.

Please report any damage or issues with the plants immediately by contacting us.

6. Availability

Plant availability is subject to inventory and may change without notice. If a plant you ordered becomes unavailable, we will contact you to offer a suitable replacement or a full refund for that item.

7. Use of Services

You agree not to:

• Use our services for any unlawful purpose
• Attempt to gain unauthorized access to our systems
• Interfere with the proper functioning of our website
• Submit false or misleading information
• Sublease or transfer rented plants to third parties

8. Limitation of Liability

To the maximum extent permitted by law, The Borrowed Garden shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services.

Our total liability for any claim related to our services shall not exceed the amount you paid for the rental order in question.

9. Indemnification

You agree to indemnify and hold harmless The Borrowed Garden and its owners, employees, and agents from any claims, damages, or expenses arising from your use of our services or violation of these terms.

10. Changes to Terms

We reserve the right to modify these terms at any time. Changes will be effective immediately upon posting to our website. Your continued use of our services after changes constitutes acceptance of the modified terms.

11. Governing Law

These terms shall be governed by and construed in accordance with the laws of the State of South Carolina, without regard to its conflict of law provisions.
